Oracle Wins Copyright Appeal Against Google

According to an article from Reuters, a federal appeals court recently handed Oracle a victory over Google Inc. The three-judge panel ruled that Oracle could copyright some of Java programming language that Google used in the design of its Android smartphones. The decision overturns a previous ruling from a San Francisco federal judge that Oracle could not claim copyright protection, stated the article. At the heart of the lawsuit was Oracle’s claim that Google infringed on 37 copyrighted APIs (application programming interfaces). The company is seeking around $1 billion in copyright claims from Google, who had argued that software shouldn’t be allowed to be copyrighted, but only patented. Oracle’s general counsel stated that the victory was a win for an entire industry in which copyright protection is used to fuel innovation, the article stated. In the previous ruling, U.S. District Court Judge William Alsup had ruled that Google’s replication of the Java APIs was not a copyright violation and that the APIs were free for anyone to use. The recent ruling orders Alsup to hear proceedings on whether Google’s use of the API was protected under fair use, in light of their decision that the APIs could, in fact, be copyrighted.
